1. Acceptance of Terms

By accessing or using The Apex Circuit website, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, then you do not have permission to access the Service. These terms apply to all visitors, users, and others who access or use the social casino platform.

The Service is operated and maintained by Iconic Turns GmbH, a company registered in Germany with the registration number HRB 241908 B. Our registered office is located at Friedrichstraße 123, 10117 Berlin, Germany. All references to "we", "us", or "our" in these terms refer to Iconic Turns GmbH.

3. Eligibility & Minimum Age (18+)

You must be at least 18 years of age to use this Service. By using the Service and agreeing to these Terms, you represent and warrant that you are at least 18 years of age. We reserve the right to request proof of age at any stage to verify that minors are not using the Service. Any accounts found to belong to underage users will be immediately terminated.

4. Pure Free Play & No Real Money Guarantee

The Apex Circuit is a free-to-play social casino designed strictly for entertainment purposes. We explicitly guarantee that no real money gambling occurs on this platform. You cannot deposit real money, nor can you win real money or real-world prizes. Any simulated wins within the games are purely visual and add to your virtual APX balance only.

5. Guest Play vs Registered Accounts

Users may access the Service as a Guest without providing personal information, utilizing temporary local storage for their balance. However, to persist your VIP tier, leaderboard status, and APX token balance across different devices or sessions, you may opt to upgrade to a Registered Account. You are responsible for safeguarding the password that you use to access the Service.

6. Virtual Currency (APX) Rules

Apex Tokens (APX) are the exclusive virtual currency used within The Apex Circuit. APX is licensed to you on a limited, personal, non-transferable, non-sublicensable, and revocable basis solely for your personal use within the Service. APX has no cash value and cannot be exchanged, sold, or redeemed for real money, goods, or other items of monetary value from us or any other party.

7. Simulated In-Game Purchases

The VIP Paddock Store offers "Simulated Purchases" where users can claim packages of APX tokens. These packages do not require real money payment and do not involve any real financial transaction. They are a simulated feature designed to replicate an e-commerce flow for entertainment purposes only. We reserve the right to manage, regulate, control, modify, or eliminate virtual currency as we see fit.

8. Prohibited Conduct & Fraud Prevention

You agree not to engage in any prohibited conduct, including but not limited to: using the Service for any unlawful purpose, exploiting glitches or bugs for unfair advantage, using automated systems or bots to play games or accumulate APX, or attempting to reverse engineer the website. We actively monitor for such activities to ensure a fair social environment.

9. Intellectual Property Rights

The Service and its original content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Iconic Turns GmbH, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

10. Limitation of Liability

In no event shall Iconic Turns GmbH, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

11. Dispute Resolution & Governing Law (Germany)

These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

12. Termination of Access

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease, and any virtual currency (APX) accumulated will be permanently forfeit.
